[[REGISTERED ADDRESS]]
VAT ID (NIP): [[NIP]]
E-mail: [[E-MAIL ADDRESS]]
The e-mail address above is the main channel for orders, withdrawal and complaints.
We answer on business days.
2. Definitions
- Seller — the entity named in section 1.
- Customer — anyone who places an order in the shop.
-
Consumer — a natural person buying for purposes not directly related to their
trade, business or profession.
-
Sole trader on consumer terms — a natural person entering into a contract
directly related to their business where the contract is not of a professional
character for them. Sections 7 and 8 protect them on the same footing as a Consumer.
-
Made-to-order item — a product made or painted to the Customer's own
specification (see sections 6 and 7).
3. Placing an order
- Orders are placed through the shop. No account is needed — an e-mail address is enough for us to send you the confirmation.
- Product listings are an invitation to treat, not a binding offer.
- Before you submit the order you see the total amount payable, including delivery and any payment-method fee.
- You place the order by clicking “Order with obligation to pay”. Clicking it creates an obligation to pay.
- The contract is concluded when we confirm acceptance of your order by e-mail. If we cannot fulfil the order, we tell you promptly and refund everything we received.
- We provide the confirmation of the contract together with these terms on a durable medium (e-mail).
4. Prices and payment
- Prices shown in the shop include VAT.
- The binding price is the one shown in the order summary at the moment you place the order. Later price changes in the shop do not affect orders already placed.
- Delivery cost and any payment-method fee are shown separately before you submit the order.
- Available payment methods are presented at checkout. Payments are handled by a payment provider, whose own terms govern the payment transaction itself.
- We issue a VAT invoice on request. Tick the relevant option and enter your invoicing details before submitting the order.
5. Delivery
- We ship from Poland (EU). Available delivery methods and costs are shown at checkout, before you submit the order.
-
Items held in stock are dispatched within
[[DISPATCH TIME — e.g. 2-5 business days]] of payment
being credited. Lead times for made-to-order items are agreed individually (section 6).
- Unless another date is agreed, we hand the goods over no later than 30 days after the contract is concluded. If we are late, you may set an additional period and — if that passes without delivery — withdraw from the contract.
- The risk of accidental loss or damage passes to a Consumer when the carrier hands the goods over to them. This does not apply where the Consumer chose a carrier other than those offered by the Seller.
- We suggest checking the parcel on delivery. This is not an obligation, and declining to write a damage report does not take away any of your rights — a report only makes claims against the carrier easier.
6. Handmade goods and commissions
-
Our products are cast and painted by hand. Small differences between individual
pieces — in shade, finish or texture — are a feature of handmade work, not a defect.
Photographs in the shop show representative pieces.
- Models are sold either unpainted or painted; the product description states which. Kits that require assembly are marked as such.
-
For commission work (painting to your brief, a chosen colour scheme, personalisation) we
agree the scope, price and lead time before accepting the job. We confirm what was agreed
by e-mail, and that confirmation is what binds both sides.
-
Goods made to your specification or clearly personalised are not covered by the right
of withdrawal — see section 7 and the
Right of withdrawal notice.
- These products are not toys. They contain small and sharp parts and are not intended for children under 14.
7. Right of withdrawal
-
A Consumer, and a sole trader on consumer terms, may withdraw from a distance contract
within 14 days without giving a reason and without costs other than those stated
in the notice.
-
The full notice, the model withdrawal form, the exceptions and the effects of withdrawal
are in a separate document: Right of withdrawal.
It forms an integral part of these terms.
-
The right of withdrawal does not apply to goods made to the Consumer's
specification or clearly personalised. We tell you about this before you place the order.
8. Complaints — goods not in conformity
-
We must deliver goods that conform to the contract. A Consumer has statutory remedies for
lack of conformity. The Seller is liable for a lack of conformity existing at the
time of delivery and becoming apparent within 2 years of that time.
- Send complaints by e-mail to the address in section 1. Describe what is wrong and quote your order number. Photographs help.
-
You may first ask for repair or replacement. You may ask for a price reduction or
withdraw from the contract where repair or replacement is impossible or would involve
excessive costs, where we refused them, or where we failed to bring the goods into
conformity.
- We answer a Consumer's complaint within 14 days of receiving it. Silence within that period counts as accepting the complaint.
- The costs of repair or replacement, including return shipping of the item complained about, are borne by the Seller.
- For Customers who are neither Consumers nor sole traders on consumer terms, liability under statutory warranty is excluded.
9. Out-of-court dispute resolution
A Consumer may use out-of-court complaint and redress procedures, in particular mediation
run by the Regional Inspectorates of the Trade Inspection and help from the district
consumer ombudsman. The Polish Office of Competition and Consumer Protection publishes
details at uokik.gov.pl.
Using these procedures is voluntary for both sides. You do not have to use them in order to
pursue your rights in court.
10. Personal data
The controller of Customers' personal data is the Seller named in section 1. The purposes,
legal bases, retention periods and your rights are described in the
Privacy Policy.
11. Final provisions
- Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Consumer Rights Act and the GDPR.
-
The choice of Polish law does not deprive a Consumer of the protection given by
the mandatory rules of the country of their habitual residence (Article 6(2) of the
Rome I Regulation).
-
We may change these terms for good reason — a change in the law, a change in how we
fulfil orders, or a change of the Seller's details. Orders placed before a change are
governed by the terms as they stood when the order was placed.
- If any provision turns out to be invalid, the remaining provisions stay in force.
